    At this point, you may be as sure as Angela Prosinski, the juror from the first trial that I spoke with in episode 4, that Cal murdered his wife. After all, there are a lot of things that, taken as a whole, could equate to Cal being a murderer. You have people who say Cal threatened Michele and was angry and controlling. You have the prosecution telling you that Michele and Cal were in the midst of a bitter divorce, a divorce that Cal did not want. And you have a small amount of blood found in the Harris’ estate. Conversely, you may be just as certain that he didn’t do it. As Bruce Barket points out, the small amount of blood found in the Harris’ estate does not equate to a crime scene – much less, the place where Cal killed Michele. And what about all of the resources dedicated to investigating Cal as the murderer.   • Ep. 7 – Bruce Barket, Cal Harris’ Defense Attorney, Joins #WiehlOfJustice

    Based on district attorney Kirk Martin’s comments after the third trial it seems like there will be a fourth trial. A “not guilty” verdict is still a possibility for Cal Harris. However, so far this is the best outcome he has had. In both of the first two trials, he was found guilty. Twelve people in the first trial and twelve in the second were able to agree that Cal Harris killed Michele. But, in the latest trial, only six of the jurors were sure of Cal’s guilt. That says a lot about Cal’s new legal team which is lead by Bruce Barket. The evidence is not really changing and the witnesses are remaining almost exactly the same from trial to trial. You would have to figure that Mr. Barket, the one arguing on Cal’s behalf, is at least partially responsible for the deadlocked jury. Mr. Barket specializes in criminal defense cases. He is no stranger to high profile cases and success. Mr. Barket secured the release of Amy Fisher, also known as the “Long Island Lolita,” who was convicted of shooting her lover’s wif

  • Ep. 6 – The Jury is Deadlocked in the Third Trial

    Going into the third trial, Cal is making an effort to uncover the truth. The third trial began on February 5, 2015. Once again, the prosecution’s theory is that Michele was murdered and that Cal was the one with the motive and the opportunity to do it. The evidence will show this to the jury. The Defense argued that investigators have spent years looking at the wrong man. The marriage wasn’t perfect, but it was not unlike any other strained marriage. A major difference between this third trial and the first and second is what the jurors did. After 11 weeks of testimony, on April 30th, Cal Harris’ fate was once again in the hands of twelve jurors. On May 5th, the jurors delivered a note to Judge Bartlett, saying they were deadlocked. What this means is that they were unable to come to a unanimous verdict. Judge Bartlett issued what’s called an Allen charge, which is an instruction given to a deadlocked jury, encouraging them to continue deliberating until they reach a verdict.     On July 13, 2009 – A little more than two years after Cal was found guilty in the first trial – the second trial begins. You see, despite the fact that the first conviction was thrown out, the indictment against Cal still stood, so if the prosecution wanted to try again, they could. And, they did. A lot of the same characters from the first trial testify in the second trial. But, there are two new important players to testify: Cal Harris and Kevin Tubbs.     This first trial is the foundation for all of the subsequent trials. When I started pouring over all the information related to this case, I may have had a preconceived idea about what happened and whether or not Cal was involved. The more involved I get, though, the more I go back and forth on whether I think Cal had motive enough to kill the mother of his kids. One thing I know for sure is that the evidence against him is a tad thin. There’s a lot of info about him being a bad husband. But none of that really tells me beyond a reasonable doubt that he’s a murderer. In the end, though, what really matters is how the jury felt about the evidence. On June 6, 2007, after closing arguments by both sides, judge smith begins his instructions to the jurors. So I spoke with Angela pro-sin-ski, who was a juror in the first trial. she was one of the twelve who listened to both sides of the story and sat in the courtroom with Cal Harris.     New York state police investigator Steven Andersen examined the harris residence between the 12th and the 19th of September. He talks about how there were no signs of forced entry into the Harris home. And there was no blood found in any of the Harris’ vehicles, boats, and ATVs. what was found on Michele’s van – the van left at the end of the driveway – were eleven fingerprints.
